Daniel Waite, Sr. appeals from an unequal property division awarded him in a divorce judgment. In response, his ex-wife, Margaret Susan Waite, has filed a motion to dismiss his appeal because he accepted substantial benefits awarded to him in the divorce decree. Because Mrs. Waites motion has merit, we dismiss Mr. Waites appeal, addressing only his thirteenth issue, which claims that the trial court lacked subject matter jurisdiction over the Waites Christian marriage. In granting Mrs. Waites motion, we conclude that the motion was timely filed, that Mr. Waite did not prove that he accepted the benefits only because of economic necessity, and that a reversal and remand could affect Mr. Waites rights in the property he was awarded.
